General Terms and Conditions (GTC)

Conditions

The following terms and conditions of sale and delivery apply exclusively to business transactions between picotronic gmbh and its customers. They take precedence over any other terms and conditions that may have been sent or are contained in other documents.

Deliveries

All items listed on the website are generally delivered from stock. If delivery cannot be made from stock, the order confirmation will state the expected delivery date. Service orders will in all cases be confirmed with an estimated delivery date.

If an order cannot be delivered in a single shipment, no shipping costs will be charged for subsequent deliveries. Under no circumstances shall picotronic gmbh be liable for delays in delivery for which the manufacturing company or subcontractors are responsible.

Technical data, changes, liability

All technical data and dimensions of the items offered are based on the information provided by the manufacturers concerned and do not constitute a guarantee by picotronic gmbh for specific properties.

Published assembly instructions and electronic circuits or software (programs) may be protected by patents or utility models. The production, offering, marketing and commercial use of the contributions are only permitted with the written consent of picotronic gmbh and, if applicable, the owner(s) of the property rights. Only private use is free. The product names used may be protected trademarks which may only be used in accordance with the trademark with the consent of the owner. The applicable legal and postal regulations concerning the construction, acquisition and operation of transmitting equipment must be observed. Liability for the correctness and usability as well as for the correctness of the technical content of the published contributions, electronic circuits and software (programmes) is excluded in any case. Although all contributions and information have been prepared with the greatest care, liability for possible errors or damage during use is excluded. picotronic gmbh is liable only in the event of proof of negligence or wilful misconduct. The customer himself is responsible for the use of the products, construction manuals, electronic circuits or software (programs) (commissioning, putting into circulation). This applies in particular to any resulting consequential damage or costs. Under no circumstances shall picotronic gmbh be liable for lost sales or profits or other financial losses that may arise from the use or application of the circuits, programs or instructions published here.

Prices

All prices are quoted in Swiss francs (CHF) and include value added tax. The published prices are subject to typographical, printing or arithmetical errors and picotronic gmbh reserves the right to take into account any price changes made by the manufacturers. We make every effort to keep the published prices up to date. Postage and packaging (shipping costs) are always invoiced separately according to the valid rates of the Swiss Post.

Payment

All prices quoted are net prices. Invoices must be paid within 30 days of the invoice date without any deductions. If the payment deadline is exceeded, picotronic gmbh is entitled to charge interest on arrears of 7%. Deliveries abroad are made exclusively against advance payment or cash on delivery. This is also expressly reserved for deliveries within Switzerland.

Retention of title

The delivered goods remain the property of picotronic gmbh until the invoice balance has been paid in full and picotronic gmbh is entitled to make a corresponding entry in the register.

Data protection

picotronic gmbh respects the privacy of its customers in all cases. Personal data of the customer collected in the case of an order will be used only and exclusively in the context of the customer relationship. picotronic gmbh irrevocably undertakes not to pass on any personal data to third parties in any form whatsoever without the express consent of the customer.

Warranty

The usual warranty period is 2 years. However, the manufacturer expressly reserves the right to make other statements and warranty provisions. The warranty period begins with the invoice date of the delivery. The invoice shall be deemed to be the warranty certificate. Damage resulting from modifications or repairs carried out by the customer, all cases of force majeure or failure to comply with the manufacturer's operating instructions or specifications are expressly excluded from the warranty. In the case of warranty claims, the material subject to complaint must be sent or delivered to picotronic gmbh together with a copy of the invoice.

Complaints and returns

Complaints must be made within 10 days of the invoice date, otherwise the delivery is deemed to have been accepted. Within these 10 days there is also a general right of return under the condition that the delivered goods are returned in unused and unused condition in the original packaging and complete. In the event of non-compliance with this condition, the customer shall be liable for the corresponding repair. Generally excluded from this right of return are service orders executed on behalf of the customer, goods specially ordered on behalf of the customer and opened software (programmes) as well as generally all types of consumables. In the event of complaints or returns, the material must be sent or delivered to picotronic gmbh together with a copy of the invoice.

Place of jurisdiction

The business activities of picotronic gmbh are based exclusively on Swiss law. The place of performance and jurisdiction is the registered office of picotronic gmbh. The original German text is binding in all cases.
